Ricardo Tosto; Esteemed Brazilian Lawyer

Ricardo Tosto is a Brazilian lawyer and has even been nominated before as one of the best. He has an undergraduate degree in law and also has done other extension courses in business administration. Ricardo Tosto is also one of the founding members and a partner of Leite, Tosto, and Barros.

Lawyer Ricardo Tosto and the firm; Leite, Tosto, and Barros dealt with a case on causation that involved the division of assets in a parallel marriage and a stable union. This alleged stable union was between a man who was already and still married to another woman and the plaintiff, a lady who alleged they were in a stable union. The stable union between them, however, came to an end long before the divorce between the partners was made official.

The superior court of justice however did not approve the division of assets because the man was still married and his wife was not called to the suit and it found that it had right to defend the ex-husband and the woman in the stable union, which then implied that their companion was separated but the wife had not permanently left the home as the partner would sometimes come to spend weekends and live together.

The partner in the stable union, however, argued that the ex-wife did not take part in the acquisition of the wealth and assets and thus she was guaranteed to be part of the deal with her stable partner. The man however referred to it as adultery as he continued to live with his ex-wife and if the assets were to be shared it be hurting the ex-wife, although the court considered this case to be a double bond and the stable union was however recognized even if the man was still married to his ex-wife.

Lawyer Ricardo Tosto although determined the case decision that enabled the sharing of assets which were acquired during the conjugal relationship with the ex-wife and all the property that was included to be under her name. The ex-wife, however, said that there was marital coexistence between them although there was the process of separation. Ricardo Tosto, however, reports that these words used by the ex-wife would have to make her explain the existence of that conjugal relationship or marriage that she claimed was in existence.
